Thank you for using Sumboard. By accessing or using Sumboard Services(as defined below), you agree to be bound by these Terms. Please review them carefully, as they form a legal agreement between You and Sumboard. The terms “you”, “your” or “yours” refer to you personally (i.e., the individual who reads and agrees to be bound by these Terms) and, if you access the Sumboard Services on behalf of a legal entity, to that entity. If you do not agree to any provision of these Terms of Use, you are not permitted to access or use the Services in any manner, even if you already have an account.
The Sumboard Services are operated and managed by BEND TECHNOLOGIES RO, a limited liability company with its registered office at Jud. Iasi, at Hlincea Street, no. 47, Romania under number RO46272445.
These Terms of Use (“Terms”) set forth the legally binding terms and conditions that govern your use of the Sumboard Services. Access to and use of the Sumboard Services is subject to your acceptance of and compliance with these Terms.
Key Definitions
The definitions below (and those provided elsewhere in these Terms of Use) apply in the context of our agreement:
- “Account”: a unique profile created by Users to gain access to and utilize the services provided through the Sumboard Digital Platform.
- “Digital Platform”: our interactive online platform that enables you to connect and combine data and create and modify dashboards, in order to get actionable insights from this data located at https://editor.sumboard.io/ & https://app.sumboard.io/.
- “Documentation”: all supplementary information provided by Sumboard to Users about the software’s usage, accessible via https://www.sumboard.io/.
- “Sumboard Services” or “Services”: encompasses all services Sumboard offers to Users, which may include access via the website and/or the digital platform.
- “Personal Data”: as defined by the General Data Protection Regulation.
- “User”: any individual or entity who creates an Account or uses our Services without one. This category includes Website Visitors, Customers, and Authorized Users.
- “Website”: Sumboard’s own site, located at https://www.sumboard.io/.
Sumboard’s Services
Sumboard’s services empower you to seamlessly integrate and analyze data from various sources, including cloud services, databases, and local files. This functionality allows you to create and modify dashboards to derive actionable insights from your data. Users have the flexibility to use these dashboards for personal purposes, share them with other users or groups within the platform, embed them in websites or apps, or extend access through third-party permissions. The use and access of Sumboard’s Digital Platform are governed by these Terms of Use, which apply to all users and entities (where “entity” includes both natural persons and any type of incorporated or unincorporated entity) that a user represents, or has granted permission to use and access the Digital Platform. These Terms also govern the content, information, and services—whether free or paid—provided through the website and/or the Digital Platform by Sumboard, its representatives, its users, or any relevant third party.
Each time you access or use the Digital Platform, you affirm and confirm your agreement, and the agreement of all persons you represent or permit access, to abide by these Terms of Use without limitation or qualification. You also represent and warrant that you have the legal authority to accept these Terms of Use on behalf of yourself and all persons you represent or permit access. Consequently, these Terms of Use form a legally binding agreement between Sumboard and you. If you do not agree with any part of these Terms, or if you are not authorized to accept these Terms, you must immediately stop accessing and using the Digital Platform.
By choosing to use our services, you acknowledge that you have read and understood the following policies of Sumboard, which outline how we process your Personal Data and use cookies:
Account Creation Process
To access certain features of a Sumboard Services, you may need to create a Sumboard Account. You must be at least thirteen (13) years old to have a Sumboard Account.
This age requirement ensures compliance with legal regulations due to the nature of our services. In case an account is found to have been created by someone under the age of thirteen (13), we reserve the right to close such accounts. When registering, you must provide accurate, complete, and current information. It is your responsibility to maintain the security of your account and password and to notify us immediately of any unauthorized use. You are responsible for all activities that occur under your account.
User Licensing Agreement
As between the parties, you or your licensors retain all rights, title, and interest in and to any content (“Customer Content”) you upload, submit, or otherwise provide to Sumboard. By using Sumboard’s services, you consent to Sumboard and its third-party service providers accessing and using your Customer Content solely to provide the services outlined in these Terms of Use, including any associated Privacy Policy. Additionally, you grant Sumboard the right to use your name, mark, and logo on the Sumboard website and in any Sumboard publication or marketing materials for the purpose of identifying you as a Sumboard customer. Any other use of your name, mark, or logo by Sumboard shall require your express written consent.
You are solely responsible for ensuring the legality, appropriateness, and compliance with all applicable laws and regulations of all Customer Content you upload, submit, or otherwise provide to Sumboard. This includes, but is not limited to, compliance with import, export, copyright, privacy, and data protection laws and regulations that are specific to you and not generally applicable to personal data. Sumboard does not monitor Customer Content, and you are solely responsible for monitoring it and handling any notices received regarding potential violations of rights, including notices pursuant to the Digital Millennium Copyright Act (DMCA).

Guidelines for Site Usage
You are granted permission to view, copy, and print the contents of the Sumboard Site under the following conditions:
- Personal Use: You may use the content of the Site for personal, informational, and non-commercial purposes only. Any modification, public display, performance, distribution, or commercial use of the materials on the Site is strictly prohibited.
- Copyright Notices: Any copies or portions of the content must include Sumboard’s copyright and other proprietary notices.
- No Modifications: No modifications or reproductions of the materials are allowed.
- Revocation of Authorization: Sumboard reserves the right to revoke this authorization at any time, and any unauthorized use may result in the termination of your permission to use the Site.
- Automated Access: You may not use any automated systems, such as “robots” or “spiders,” to access the Site in a way that sends more requests to the servers than a human can reasonably produce using a conventional web browser. Exceptions are made for public search engines to create searchable indices, but not caches or archives.
- Personal Information: You may not collect or harvest any personally identifiable information from the Site, nor use the Site’s communication systems for commercial solicitation purposes.
- Security Features: You may not circumvent, disable, or interfere with security-related features of the Site, nor features that enforce limitations on the use of the Site or its content.
Usage of the Sumboard Digital Platform
The Sumboard Digital Platform allows users to integrate and analyze data from various sources, including cloud services, databases, and local files. Users can create and customize dashboards to derive actionable insights from their data. Dashboards can be used for personal applications, shared with other users or groups on the platform, embedded into websites/apps, or shared externally through third-party permissions.
Sumboard may, at its discretion, offer updates to the Digital Platform, although it is not obligated to do so. These updates aim to enhance functionality and user experience.
Sumboard offers a 30-day free trial of its Digital Platform, allowing new users to explore and familiarize themselves with its features at no cost. During the trial, users can:
- Upload, link, and adapt data from various sources, including cloud services.
- Connect and blend data from any source for comprehensive analysis.
- Create, modify, and manage custom dashboards.
- Set up third-party permissions for dashboard access.
- Securely embed dashboards into websites or applications.
This free trial is designed to provide prospective users with a thorough understanding of the platform’s capabilities and how it can benefit their business operations.
Usage Restrictions on the Digital Platform
When using the Sumboard Digital Platform, you are obligated to adhere strictly to its intended purpose as specified in these Terms of Use. Within the confines of applicable laws, the following activities are expressly prohibited:
Prohibited Content: You may not upload, download, post, email, analyze, or otherwise transmit any materials that are unlawful, harmful, threatening, abusive, vulgar, harassing, defamatory, obscene, pornographic, indecent, inflammatory, libelous, tortious, hateful, or objectionable on racial, ethnic, social, political, legal, moral, or religious grounds, or that violate another’s rights including rights of celebrity, privacy, and intellectual property.
Privacy Violations: You are forbidden from uploading, downloading, posting, emailing, analyzing, or transmitting any content that violates an individual’s privacy rights or incorporates images or names without consent.
Impersonation: Impersonating any person or entity or falsely misrepresenting your affiliation with any person or entity is not allowed.
Illegal Activities: You may not use the platform to encourage or conduct criminal activities, or to violate the rights of any party which would lead to liability or violate any local, state, national, or international law.
Unsolicited Communications: Sending or transmitting unsolicited advertisements or promotional material, such as junk mail or spam, is prohibited.
Malicious Software: Distributing content that contains viruses or is designed to disrupt, damage, or limit the functioning of any software or hardware is strictly prohibited.
Misinformation: You must refrain from uploading, downloading, posting, emailing, or transmitting any content that is false or misleading.
Security Breaches: Interfering with the security of the website, digital platform, systems, accounts, servers, or networks connected to or accessible through Sumboard or its affiliated sites is prohibited. Accessing non-public areas of the platform without authorization is subject to prosecution.
Interference with Operations: Disrupting or interfering with any other user’s enjoyment of the platform or related services is not permitted.
Unauthorized Usage: You may not make the platform available to third parties for their use or benefit, such as through sale, rental, or subleasing.
Modifications and Reverse Engineering: Modifying, adapting, translating, reverse engineering, decompiling, disassembling, or deriving the source code of the Digital Platform is strictly forbidden.
Intellectual Property Violations: Altering or obscuring any copyright notices, digital watermarks, proprietary legends, or other notices related to the Digital Platform is not allowed.
Destructive Activities: Intentionally distributing worms, Trojan horses, corrupted files, or other destructive or deceptive items through the Digital Platform is prohibited.
Disclaimer
Except as expressly specified in these Terms of Use, the Sumboard Services are provided “as is” and on an “as available” basis. Sumboard, its licensors, resellers, and third-party service providers make no express, implied, statutory, or other warranties, representations, or guarantees of any kind regarding the Services or any third-party services. This includes, without limitation, any warranty, representation, or guarantee that the Services or any third-party services will be uninterrupted, error-free, free of harmful components, or that any data or results, including Customer Content, will be secure or free from loss or damage.
Without limiting the foregoing, Sumboard, its licensors, resellers, and third-party service providers disclaim all warranties of merchantability, satisfactory quality, fitness for a particular purpose, and non-infringement. Additionally, they disclaim all warranties arising from any course of dealing or usage of trade.
You acknowledge the inherent risks associated with internet connectivity, big data analysis, and processing, which could result in the loss of privacy, data, results, confidential information, and property belonging to you or third parties. Furthermore, you acknowledge that the Services are not intended for use in connection with the operation of nuclear facilities, air traffic control, or life support systems, where the use of or failure of the Services could lead to or contribute to death, personal injury, or environmental damage.
Limitations of Liability
In no event shall Sumboard, its licensors, resellers, and third-party service providers be liable to you or any third party for the cost of procurement of substitute goods or for any indirect, incidental, special, exemplary, or consequential damages. This includes, but is not limited to, loss of profits, loss or corruption of data, business interruption, loss of business, or claims of third parties, regardless of the cause of action (including without limitation contract or tort), even if advised of the possibility of damages and even if damages are foreseeable.
Notwithstanding any other provision in these Terms of Use, the maximum aggregate liability of Sumboard, and its officers, directors, employees, advisors, representatives, licensors, resellers, and third-party service providers, to you and all third parties, under any cause of action, shall not exceed the fees actually received by Sumboard from you in the twelve (12) months immediately preceding the first occurrence of an event giving rise to a claim. This limitation of liability is an aggregate limit, and the existence of more than one claim shall not enlarge this limit.
You acknowledge that this foregoing limitation of liability is an essential part of these Terms of Use, and absent such limitation, Sumboard would not provide the Services to you or enter into these Terms of Use.

Term and Termination
Sumboard reserves the right to terminate your access to and use of the Services immediately if it determines or has reasonable grounds to believe that you are in breach of these Terms of Use.
Sumboard may, at its sole discretion, at any time and for any reason:
- Modify, suspend, or discontinue the Digital Platform or any part of its services or functionalities; or
- Restrict, suspend, or terminate your account, access, or use of the Digital Platform, and/or remove any content you have provided or acquired through the Digital Platform without any notice or liability to you or anyone else.
You acknowledge that Sumboard may terminate your access to the Digital Platform under these Terms without prior notice. Upon termination, Sumboard may deactivate or delete your account and all associated information, files, and content, and bar any further access to such files or the Digital Platform. Accounts terminated by Sumboard, especially free trial accounts, may not be recoverable or restored, and could be immediately erased from our systems.
Furthermore, Sumboard shall not be liable to you or any third-party for any termination of your access to the Digital Platform.
If you disagree with any provisions of these Terms of Use or are dissatisfied with the Digital Platform, you are advised to email Sumboard at [email protected] to address your concerns or to discontinue using the Digital Platform and terminate your account.
Effects of Termination
Upon the termination of your rights to access and use the Services:
Data Handling: Sumboard will securely delete or anonymize your Personal Data associated with your account within thirty (30) calendar days following the termination. Any Personal Data that must be retained to comply with legal and regulatory obligations may be kept by Sumboard beyond this period as required by law.
Data Retrieval: Should you request it in writing no later than fourteen (14) days before termination, Sumboard will provide you with a readable and usable copy of your Personal Data immediately before it is sanitized, anonymized, or destroyed.
Continuation of Certain Obligations: While most rights and obligations end with the termination, specific provisions designed to survive termination will remain in effect as outlined in these Terms.
Free Trial Users
- Ending Your Trial: You may terminate your free trial at any time without penalty by notifying Sumboard at [email protected].
- Communication During Trial: During the trial, Sumboard may reach out to discuss transitioning to a paid account. If you choose to convert to a paid account, your data and access will seamlessly continue without disruption or data loss, mitigating the risks described in the termination effects.
